HARRY POTTER AND THE ORDER OF THE PHOENIX™ DVD COMPETITION RULES
  1. This competition (“Competition”) is open to residents of the United Kingdom aged twelve (12) years and overexcept employees of Microsoft Limited (“Microsoft”) and its subsidiaries, affiliates, advertising and competition agencies and their immediate families (defined for the purpose of these rules as husband, wife, mother, father, sister, brother, son, daughter, or persons residing in the household of such employees), and anyone else professionally connected with this Competition.  The promoter reserves the right to verify the eligibility of entrants and check their identity.  Entrants who are under the age of eighteen (18) must seek their parent’s or guardian’s permission before entering this Competition.
  2. Entrants will be deemed to have accepted these terms of service (“Terms”) when they enter this Competition as described in paragraph 5.
  3. The prize for this Competition (“Prize”) shall be provided by Warner Entertainment UK Limited (“Warner”) on behalf of Microsoft, and includes:
  • a visit to the “Harry Potter and the Half-Blood Prince” film set on a date to be notified by Warner subject to production schedules, including participation in a crowd scene (“Walk On Prize”);
  • two nights twin share accommodation beginning from one night before the Walk On Prize in a hotel specified by Warner;
  • reasonable travel costs from the station or airport (as applicable in Warner’s sole discretion) nearest to the Winner’s residence to the hotel;
  • reasonable travel costs to and from the “Harry Potter and the Half-Blood Prince” film set on the day of the Walk On Prize;
  • one evening meal at the hotel for the Winner and his/her guest on the night of the Walk On Prize;
  • catering on the “Harry Potter and the Half-Blood Prince” film set during the day of the Walk On Prize; and
  • insurance for the Winner during the Walk On Prize.

The Winner will participate in the Walk On Prize as an extra in a crowd scene which may or may not be a silent scene. There is neither a guarantee that the Winner will be able to distinguish himself/herself in the film footage, nor that he/she will be featured in the final cut of the “Harry Potter and the Half-Blood Prince” film which is always subject to creative approvals and the Director’s final say. There is no guarantee that the Winner will meet or see Talent as part of the Walk On Prize.
Any costs incurred additional to the Prize as detailed in these Terms will be at the expense of the Winner including, without limitation, any meals, drinks, spending money, transfers to and from departure point, telephone calls, room service, insurance and the costs and expenses of anyone accompanying the Winner. All taxes (excluding VAT) which may be payable as a consequence of receiving the Prize are the sole responsibility of the Winner.
The Winner may be accompanied on the trip by one (1) guest.  If the Winner is under the age of eighteen (18), the Winner’s guest must be a parent or guardian of the Winner who is eighteen (18) years of age or older.  The guest shall not be permitted to visit the “Harry Potter and the Half-Blood Prince” film set, nor participate in the Walk On Prize unless the Winner is under the age of eighteen (18), in which case their parent or guardian shall be permitted to visit the “Harry Potter and the Half-Blood Prince” film set with the Winner, but shall not be permitted to participate in the Walk On Prize. The Winner and their guest must travel together.
The Walk On Prize will, unless otherwise notified by Warner, take place on a weekday. The date of the Walk On Prize may be subject to change due to the rescheduling of the “Harry Potter and the Half-Blood Prince” production schedule. In the event of rescheduling, any change to the date of the Walk On Prize will be communicated to the Winner within a reasonable time of such rescheduling. If applicable, the Winner and/or their guest must obtain any approval appropriate for travel and absence, including any absence from school, during the Prize period.
As for participating in the Walk On Prize, the Winner must accept and agree to be bound by any and all specific terms and conditions and other requirements applicable for the Winner’s participation in the Walk On Prize, and as set out in detail in the Confidentiality Agreement, Production Agreement and any other document which the Winner will be required to sign for this purpose as deemed necessary by Warner in its sole discretion. The Prize is also subject to the terms and conditions of any third party services providers used as part of the Prize including, without limitation, those of any airline or hotel.
Events may occur that renders the fulfillment of the Prize (or any element thereof) impossible due to unforeseen circumstances.  In this situation, Warner may at its discretion vary or amend the Prize so as to provide a reasonable alternative and the Winner agrees that no liability shall attach to Warner or parties connected to Warner as a result thereof.
How to Enter

  1. The Competition will start at 09.00 Greenwich Mean Time (“GMT”) on 21 November 2007 and end at midnight GMT on 20 December 2007 (the “Competition Period”). No entries received outside the Competition Period will be eligible to win the Prize.
  2. To be eligible to win the Prize, entrants must register for the Competition at www.msn-harrypotter-comp (the “Website”) and answer questions in relation to the HARRY POTTER AND THE ORDER OF THE PHOENIX™ film clips displayed on the Website. A different question will be displayed each week during the Competition Period, with up to a maximum of four (4) questions during the Competition Period. Entrants may submit one (1) answer to each question via the Website (“Entry”).  Entries that have answered a question correctly (“Correct Entry”) will be included in the Prize draw detailed in paragraph 9 (“Prize Draw”).
  3. Entrants are not obliged to purchase any products (such as tickets) in order to participate in the Competition and the purchasing of any products does not influence Entrants’ chances of winning the Prize.
  4. Entries that are incomplete, defaced or damaged will be deemed invalid.  No responsibility will be accepted for Entries lost, delayed or damaged in transmission. 
  5. If any person is determined to have breached these Terms they will be disqualified from this Competition.

How to Win

  1. The Prize Draw will be held within a week of the close of the Competition Period. The first Correct Entry randomly selected by Microsoft will win the Prize (“Winner”). Microsoft’s decision is final and binding.  No correspondence will be entered into regarding the Competition.
  2. In the event that the Winner is disqualified in accordance with paragraph 8 or is not available on the dates on which the Prize must be taken for any reason whatsoever, Microsoft reserves the right to select an alternative Winner by repeating the Prize Draw in which case the original Winner forfeits his/her rights to the Prize.
  3. The Winner may be required to sign a Prize Acceptance Form before the Prize is awarded. If the Winner is under the age of eighteen (18), a parent or guardian may be required to sign a Prize Acceptance Form on behalf of the Winner.
  4. There is no cash alternative to the Prize (or any part thereof). The Prize (and any part thereof) is subject to availability, non-transferable, non-negotiable and non-refundable. 
  5. The Winner will be notified by email, telephone or post by Microsoft within a week of the Prize Draw.
  6. Details of the Winner may be obtained by sending a self-addressed stamped envelope to: HARRY POTTER AND THE ORDER OF THE PHOENIX™ DVD Competition, Microsoft Digital Advertising Solutions, 100 Victoria St, London SW1E 5JL.
  7. The Winner may not sell, offer or use the Prize (or any part thereof) in connection with any other competition, contest or promotion

Privacy

  1. The Winner may be required to participate in publicity connected with this Competition and may be filmed, photographed or otherwise recorded by Microsoft, Warner or other third parties for publicity purposes and he/she expressly consents to the use of his/her personal data for such purposes without further consent or payment.
  2. The collection of personally identifiable information for the purposes of this Competition will be subject to the Microsoft Privacy Statement, as amended from time to time (current version available at http://privacy.microsoft.com/en-us/fullnotice.aspx) (“Microsoft Privacy Statement”). The data collected through this Competition will be used by Microsoft only in connection with the running of this Competition, including (without limitation) for the purpose of sending an email to entrants to confirm whether the entrant has won the Prize or not. In addition, Microsoft may transfer the data collected through this Competition to Warner for the purpose of fulfilling the Prize. By entering into this Competition, you expressly consent to the use of your personally identifiable information in accordance with these Terms and the Microsoft Privacy Statement.  Such information may also be used by Warner in relation to the general marketing of its products and services, including via email, if you expressly consent to such use.

General

  1. If any provision or part of these Terms is deemed void or otherwise unenforceable in law then that provision or part shall be deemed excluded and the remainder of these Terms shall remain in force.
  2. These Terms, the conduct of this Competition and the interpretation and enforcement of these Terms shall be exclusively governed and construed in accordance with the laws of England, unless you are a resident of Scotland or Northern Ireland, in which case you may choose the law of your own country of residence.  Entrants irrevocably submit to the exclusive jurisdiction of the Courts of England and Wales, unless they are a Scottish resident or a resident of Northern Ireland, in which case they may choose the courts of their place of residence.
